In this privacy policy, a reference to 'Let's Play', 'we', 'our' or 'us', is a reference to Let's Play App Pty Ltd (ABN 667 187 920) and its related bodies corporate. Let's Play provides the Let's Play platform available at www.letsplayapp.com.au (Website) and available for download via the Google Play Store / Apple App Store, and related services (collectively, the Platform).

Let's Play takes data privacy seriously, and we are committed to protecting and respecting your privacy. This privacy policy describes how and why we obtain, store and process personal information. Personal information, as defined in the Privacy Act 1988 (Cth), is information or an opinion about an identified individual, or an individual who is reasonably identifiable, for example, your name, mobile number, email address, payment details and information about your access to the Website or the Platform. It does not include anonymised data, where an individual's identity and identifying information has been removed.

We will process your personal information fairly, lawfully and transparently. This privacy policy describes the personal information we are collecting about you and how it is used. We will only collect and use your personal information for the following purposes:

  • to provide our services, including the Platform and the Website;
  • to improve our services;
  • to make our marketing more relevant to you and your interests, where you have consented to receive such marketing;
  • to meet our legal responsibilities; and
  • where required or permitted by law.

2. Your Rights & Our Commitment to You

You have several rights under the Privacy Act 1988 (Cth), and Let's Play is committed to you being able to freely exercise your rights. Where possible, we have incorporated automated tools on the Platform that enable you to facilitate your rights in real-time. You can visit the 'my profile' section of your account on the Platform to access and manage the personal information we hold about you and manage your preferences.

Your rights include the right to:

  • Access and correct your personal information: You have the right to access personal information we hold about you in our records. You are also entitled to have your personal information corrected if it is inaccurate.
  • Complain to the relevant supervisory authority: Should you have any concerns or complaints regarding the way in which we process your personal information, please email us directly at dataprotection@letsplayapp.com.au. You also have the right to make a complaint to the Office of the Australian Information Commissioner (OAIC). We would, however, appreciate the chance to deal with your concerns before you approach the OAIC, so please do contact us in the first instance.

3. The Personal Information We Collect

3.1 Information We Collect from You

Depending on the type and level of engagement you have with us, we may collect the following categories of personal information in the following ways:

  • From the Platform: We receive and store information you provide directly to us. For example, when setting up a new account on the Platform, we collect personal information to be able to provide our services to you. The types of information we may collect directly from our users include: name, date of birth, gender, IP address, email address, telephone number, game data, and profile picture, as well as any other information that you choose to provide to us or upload to the Platform. This includes any personal information contained in posts or comments to the social feed.
  • From the Website: We may collect any personal information that you choose to send or provide to us via our Website. For example, if you contact us through the Website 'contact us' form, we will keep a record of our correspondence with you.

Generally speaking, Let's Play will not collect "sensitive information" about you. Sensitive information is personal information which includes information or an opinion about an individual's racial or ethnic origin, political opinions or associations, religious or philosophical beliefs, trade union membership or associations, sexual orientation or practices, criminal record, health or genetic information, and some aspects of biometric information. However, if you choose to upload sensitive information to the Platform or otherwise provide sensitive information to us, you provide your consent to the collection of that information by Let's Play.

3.2 Information We Automatically Collect

When you use the Platform or the Website, we may automatically collect the following types of information:

  • Usage information: We keep track of user activity in relation to the types of services our users use, the configuration of their computers, and performance metrics related to their use of the Platform.
  • Log information: We log information about our users when you use the Platform including location, and Internet Protocol (IP) address.
  • Information collected by cookies and other similar technologies: We use various technologies to collect information which may include saving cookies to users' computers.
  • Customer feedback: While using the Platform, you may be asked to provide feedback (e.g. in the Platform directly or after receiving help from our support team). Providing this feedback is entirely optional.
  • When you use the Platform: When you visit the Platform, we collect certain information related to your device, such as your device's IP address, referring website, what pages your device visited, and the time that your device visited the Platform.

4.1 Personal Information We Collect from You

We may collect personal information from you when you:

  • access or use the Platform, including to create or update a user account;
  • engage with us on social media;
  • contact us with queries; or
  • apply for an employment opportunity with Let's Play.

4.2 Personal Information We Collect from Third Parties

We may also collect personal information about you from various third parties, including:

  • Information provided to us by sporting associations, governing bodies, leagues, clubs or other organising entities when you enrol or participate in activities they offer via the Platform.
  • Technical data from third parties, including analytics providers such as Google. Please see further information in the section entitled 'Marketing preferences, adverts and cookies' below.
  • Technical data from affiliate networks through whom you have accessed the Platform.
  • Identity and contact data from social media platforms when you log in to the Platform using such social media platforms.
  • Contact, financial and transaction data from providers of technical, payment and delivery services.

5. How We Use Your Personal Information

We will only collect and process your personal information where we have a legal basis to do so. The legal basis for our collection and use of your personal information varies depending on the manner and purpose for which we collect it. We will only collect personal information from you when:

  • we have provided you with a collection notice in respect of that personal information; and
  • in the case of sensitive information, we have your consent to do so.

6. How We Share Your Personal Information

6.1 Disclosure to Third Parties

We sometimes share your personal information with trusted categories of third parties who we use to conduct our business, for example, to:

  • provide you with services via the Platform;
  • make payment services available to you;
  • handle feedback and complaints;
  • help us understand your behaviour in order to customise and maximise our services, advertising, marketing, competitions and offers to you;
  • provide fraud monitoring, detection, and prevention services;
  • comply with relevant laws and / or enforce our terms of service; and
  • receive professional advice in relation to our legitimate business interests.

Our trusted categories of third parties include website hosts, cloud service providers, social media providers, professional services providers, payment processors, customer survey service providers and advertising partners. We will also disclose your personal information to organisers of activities in which you enrol and participate via the Platform, such as relevant governing bodies, sporting associations, clubs and leagues.

As part of our fraud monitoring, detection and prevention methods and on the basis of our legitimate business interests, we use a third-party fraud monitoring, detection and prevention service provider for all website/online sales. As part of this service, we may share personal information that is required to make identity checks and personal information that we obtain from making identity checks (including data relating to your age, name and location), together with account information, with third party organisations (including law enforcement agencies) involved in fraud prevention and detection and credit risk reduction. Please note that these third parties may retain a record of the information that we provide to them for this purpose.

We may share your personal information with government bodies and law enforcement where permitted or required by law.

We may also share your personal information with our professional advisers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.

6.2 Overseas Disclosure

Let's Play does not routinely disclose personal information to individuals located in countries outside of Australia.

7. Marketing Preferences, Adverts and Cookies

7.1 Marketing - Your Preferences

We will only send you marketing communications if you have consented to receive such communications from us.

If you have consented to receive marketing communications, we may use your personal information (as outlined in the 'Personal Information We Collect' section) to form a view on what we think you may like, or what may be of interest to you, and to send you details of services which may be relevant for you.

We will ask you for your preferences in relation to receiving marketing communications by email, and other communication channels.

You will always have full control of your marketing preferences. If you do not wish to continue receiving marketing information from us at any time:

  • you can unsubscribe or 'opt-out' by using the unsubscribe button and following the link included in the footer of any marketing email; or
  • account holders may withdraw their consent by simply logging in to the Platform and managing their preferences in the 'my profile' section.

We will process all opt-out requests as soon as possible, but please note that due to the nature of our IT systems and servers it may take a few days for any opt-out request to be implemented.

7.2 Cookies

The Platform uses cookies to distinguish you from other users of the Platform and to keep track of your visits. They help us to provide you with the very best experience when you browse the Platform and to make improvements to the Platform. They also help us and our advertising networks to make advertising relevant to you and your interests.

You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of the Platform may become inaccessible or not function properly.

You can manage cookies as you wish in the 'my profile' section of your account on the Platform.

We may use analytics and targeted advertising tools to display relevant content on the Platform and online advertisements on other websites and apps to you. We may use these tools to deliver relevant content to you in marketing communications (where applicable), and to measure the effectiveness of the advertising provided. For example, we may use tools such as Google Analytics to target and improve our marketing campaigns, marketing strategies and website content. We may also use tools provided by other third parties to perform similar tasks.

In order to opt out of targeted advertising, please manage your preferences in the 'my profile' section of your account on the Platform.

8. Links to Other Websites and Third Parties

The Platform may include links to and from the websites of our partner networks, advertisers and affiliates, governing bodies, sporting associations, local clubs or leagues, or to social media platforms. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal information to their websites.

9. Storing, Securing and Retaining Your Personal Information

9.1 Securing your personal information

The communication between your browser and the Platform uses a secure encrypted connection wherever your personal information is involved.

We have put in place physical, electronic and managerial security procedures in the storage and disclosure of your personal information to protect it against accidental loss, destruction or damage. Nevertheless, any data transmission over the internet or by any other means can never be fully secure, such is the character of the internet, and provision of personal information by you to us is at your own risk. When we disclose your personal information to trusted third parties (for the purposes set out in this policy), we require all third parties to have appropriate technical and operational security measures in place to protect your personal information, and we work with them to ensure that your data protection and privacy rights are respected. Where your personal information is shared with a third party, it must only be used for the purposes for which it was supplied.

In the unfortunate event of a personal information breach, we will notify you and any applicable regulator when we are legally required to do so.

Your personal information will be deleted when it is no longer reasonably required for the purpose for which it was collected and we are not legally required or otherwise permitted to continue storing such data.

The length of time we keep your personal information depends on what it is and whether we have an ongoing business need to retain it (for example, to provide you with a service you've requested or to comply with applicable legal or regulatory requirements).

We'll retain your personal information for as long as we have a relationship with you and for a period of time afterwards where we have an ongoing business need to retain it, in accordance with our data retention policies and practices. For example, where you ask to be unsubscribed from marketing communications, we may keep a record of your email address and the fact that you have unsubscribed to ensure that you are not sent any further emails in the future.

We may modify this privacy policy from time to time. When we do, we will provide notice to you by publishing the most current version and revising the date at the top of this policy. If we make any material change to this policy, we will provide additional notice to you, such as by sending you an email or displaying a prominent notice on the Platform.
